An interesting note from that article:

So, you can't even explicitly exclude Colorado when advertising remote positions.

(I'm in Colorado and fully support this law and transparency in compensation)




I’m not really sure how enforceable that would be if the business has zero employees in Colorado and no offices there either?

Edit: It looks like this only has an effect when a company has presence (1+ employee) in the state already. In a worst case scenario, to avoid needing to think about and comply with this law and those like it in states where you have extremely minimal presence, I do wonder if we’ll see companies with handfuls of employees run a RIF there to eliminate their state presence and simplify their operations.

1. The Act applies to any entity employing at least one employee working in Colorado.


So basically, don't hire any Coloradans nor get offices there ?

I mean "just don't say that's what you're doing or you're in violation of colorado law" is hardly intimidating for those of us outside Colorado.

It will make Coloradans much less desirable for remote jobs though, even if you don't find out about it.
