I don't know about other states but this brings up an unusual problem with Michigan law. I worked for a number of years in a small town that had a popular bar. The owner rarely drank at work even if people offered to buy him a drink.

But one night he sat drinking with old friends. After cleaning up and closing the bar up he got in his car to drive home. It was a cold Michigan winter night and as he sat there with the heat running full blast he came to the realization that he probably shouldn't drive home. So he climbed in the back seat and went to sleep.

An hour later he was awakened with flashlights shining in his face by local police. He explained himself but after a breath analyzer test he was arrested for drunk driving. He went to court and lost. The lesson the locals took was that you're better off trying to drive home than doing the prudent thing.

So if you're drunk and a remote driver is operating your car could you still be guilty of drunk driving? In Michigan at least I bet it will be tested in court.
